 CASE NUMBER NO. 574.

 In the Matter of the Estate of SIMEON LEWIS, Deceased (A-5598)

 ORDER APPROVING DEED.

 Now on this day there comes on for hearing in open court the petition of NICEY BOND nee BOHANAN, for the approval of petitioner's deed to H. WEST made and executed on the 12th day of October 1912, conveying the allotment of SIMEON LEWIS, deceased, more particularly hereinafter described, and all parties appearing and the Court hearing heard the evidence offered in the premises and examined and considered said deed and petition and being fully advised in the matter, finds the facts to be in said petition set out, to-wit: 

 That said petitioner, NICEY BOND nee BOHANAN, is an adult citizens by blood of the Choctaw Nation, enrolled opposite No. 5597, as of the full blood; and is the wife of HARRISON BOND.

 That SIMEON LEWIS, deceased, was a citizen by blood of the Choctaw Nation, enrolled opposite No. 5598, as of the full blood;

 That on or about the 4th day of February 1905 the said SIMEON LEWIS departed this life, while still a minor about fifteen years of age, intestate, unmarried and without issue, that at the time of his death said SIMEON LEWIS  was and for many years prior thereto had been an actual resident of that part of the Central District of the Indian Territory now embraced within the boundaries of  Pushmataha County, in the State of Oklahoma; that administration upon the estate of said SIMEON LEWIS resided with his mother ELIZA BOHANAN near the town of Finley in said Central District of the Indian Territory; that this court has jurisdiction of the settlement of the estate of said SIMEON LEWIS, deceased.

 That said SIMEON LEWIS, deceased, left surviving him as his heir at law, his mother ELIZA BOHANAN and his sister NICEY BOND nee BOHANAN, petitioner herein; that said ELIZA BOHANAN the mother of said SIMEON LEWIS, deceased, departed this life about the 25th day of April 1912, leaving her daughter the said NICEY BOND nee BOHANAN as her sole heir at law, and as the sole surviving heir at law of said SIMEON LEWIS, deceased, that subsequent to the death of said SIMEON LEWIS, there was allotted him in his name and the use and benefit of his heirs at law, the following described lands, to-wit:

 Southwest 7.77 acres of Lot 3 and Lot 4 of Section 30, and Lots 1 and 2 and SE 1/4 of NW 1/4 (less 3.05 acres for right of way of KCO & H RY) of Section 31 in Township 3 South Range 15 East of the Indian Base and Meridian, situate in Pushmataha County, Oklahoma.

 Also SW 1/4 of SW 1/4 of SE 1/4 of Section 3 in Township 4 South Range 14 East and W 1/2 of W 1/2 of Section 35, all in Township 4 South Range 14 East of the Indian Base and Meridian situate in Atoka County, Oklahoma; and all of said lands are alienable and title to the same was on the 12th day of October 1912, vested in the said NICEY BOND nee BOHANAN as the sole surviving heir at law of said SIMEON LEWIS, deceased.

 That on the 18th day of October 1912, the said NICEY BOND nee BOHANAN, joined by her husband HARRISON BOND, made and executed her Warranty Deed conveying said land to H. WEST for the price and sum of One Thousand Fifty Dollars; that petitioner has testified that she is wholly satisfied with said transaction and believes the consideration paid to be the reasonable value of said land and that all of said sum has been paid to her in cash, and that said petitioner desires this Court to approve said deed.

 Now therefore it is hereby ordered that the said deed from NICEY BOND nee BOHANAN to the said H. WEST and his heirs conveying the above described land be and the same is hereby ratified and approved and in all things declared legal and valid.

 Dated this 29th day of October 1913.
