IN COUNTY COURT.
CASE NUMBER NO. 577.
In the Matter of the Estate of ISAAC SIMPSON, deceased.
Now on this the 31st day of October 1913, comes JOHN SIMPSON and files and presents to the Court his petition, praying for an order of the Court approving and confirming a certain deed of conveyance executed by JOHN SIMPSON to J. H. JACKSON, R. V. WOMACK, C. G. SHULL and G. W. DODD, on the 30th day of October 1913, to the following described real estate, to-wit:
The S 1/2 of SE 1/4 of NW 1/4 and N 1/2 of NE 1/4 of SW 1/4 and NE 1/4 of NW 1/4 of SW 1/2 and S 1/2 of NW 1/4 of SW 1/4 less 3.31 A. R. of W. A. & C. RY., of Section 13, Township 6 South, Range 15 East and SE 1/4 of SE 1/4 of Section 28, and N 1/2 of NE 1/4 of Section 34, and N 1/2 of NW 1/4 of Section 35, Township 2 North, Range 20 East and SE 1/4 of NE 1/4 of Section 36, Township 1 North, Range 16 East and SE 1/4 of SE 1/4 of NW 1/2 of Section 24 and SE 1/4 of SE 1/4 of NE 1/4 of Section 26, Township 1 South, Range 16 East and S 1/2 of NEP of SW 1/2 less 1.15 A. R. and C. RY. and S 1/2 of SW 1/4 less 1.98 A. of A. and C. RY. of Section 13, and NW 1/4 of NW 1/4 of NW 1/4 of Section 24, Township 6 South, Range 15 East.
And being of the Government appraised value of Ten Hundred Forty One and 28/100 Dollars, and the Court upon consideration of said petition, and being fully advised in the premises, finds that one ISAAC SIMPSON, a full blood Choctaw Indian, who appears upon the roll of Choctaw by blood, opposite roll No. 4757, and a resident of Pushmataha County, State of Oklahoma, on or about the 10th day of May 1909, died intestate, seized of the lands above described, which said lands were allotted to ISAAC SIMPSON by the Choctaw and Chickasaw Nations, and conveyed to ISAAC SIMPSON by allotment and homestead patent, and that the said ISAAC SIMPSON was at the time of his death the owner, in fee simple, of the above described lands.
And the Court further finds that the said petitioner and SARAH SIMPSON, LENA SIMPSON and EASTMAN SIMPSON are the sole and only surviving heirs at law of the said ISAAC SIMPSON, deceased.
The Court further finds that in the 30th day of October 1913, the said petitioner executed a certain Warranty Deed to J. H. JACKSON, R. V. WOMACK, C. G. SHULL and G. W. DODD, for and in consideration of the sum of Four Hundred Dollars, cash in hand to him paid, and did convey by said Warranty Deed all his right, title and interest in said above described real estate.
The Court further finds that the deed was duly signed and acknowledged by the petitioner and that this Court has jurisdiction, and that the consideration for the said deed is fully paid and that said consideration is more than the Government appraised value, and that the same is reasonable, adequate and wholly satisfactory to the said petitioner and finds further that the said conveyance of the real estate to the said J. H. JACKSON, R. V. WOMACK, C. G. SHULL and G. W. DODD, should be in all things approved and confirmed.
IT IS THEREFORE BY THE COURT CONSIDERED, ORDERED, ADJUDGED AND DECREED, That the said conveyance of the said conveyance of the above described lands by Warranty Deed dated the 30th day of October 1913, from the said petitioner to the said J. H. JACKSON, R. V. WOMACK, C. G. SHULL and G. W. DODD, their heirs and assigns, be and the same is hereby in all things approved and confirmed and declared legal and valid.
Dated this the 31st day of October 1913 at Antlers in the County of Pushmataha Oklahoma.
