IN COUNTY COURT.

 CASE NUMBER NO. 554.

 In the Matter of the Estate of ALLEN COLE, deceased (A-5055).

 ORDER APPROVING DEED.

 Now on this day there comes on for hearing the petition of PETER COLE, praying the Court to approve petitioner's interest in and to one hundred sixty acres of land, situate in Atoka County, Oklahoma and being a part or the allotment of ALLEN COLE, deceased, which said lands are specifically designated and described in said deed, a copy of which is attached to petition herein and made a part of the files in this cause; and said petitioner appearing in person and said purchaser appearing in person and paying into court the sum of $1,200.00 being the consideration named in said deed, and the Court having examined and considered said deed and petition and having heard the evidence offered in open court and being fully advised in the premises finds the facts to be as in said petition set forth, to-wit:

 That said petitioner is an unmarried man and is a citizen by blood of the Choctaw Nation enrolled opposite No. 5057 as of the full blood; that petitioner is the son and the surviving heir at law of said ALLEN COLE, deceased.

 That said ALLEN COLE was a citizen by blood of the Choctaw Nation enrolled opposite No. 5055 as of the full blood.

 That on or about the 10th day of February A. D. 1904, the said ALLEN COLE departed his life interest at his home near Zoraya in that part of the Central District of the Indian Territory now embraced within the boundaries of the County of Pushmataha in the State of Oklahoma; that said ALLEN COLE was an actual resident of Zoraya in the Central District of the Indian Territory for more than ten years next preceding his death; that letters of Administration upon the estate of said ALLEN COLE were issued out of the United States Court for the Central District of the Indian Territory, Antlers Division; that said cause is now pending in this Court and this Court has Jurisdiction of the settlement of the estate of said ALLEN COLE, deceased.

 That said ALLEN COLE left him surviving as his heirs at law the following persons and none other, to-wit: his son PETER COLE, petitioner herein, and his son ELIGH COLE; that thereafter on the 8th day of August 1908, the said ELIGH COLE departed this life, unmarried interstate and without issue while still a minor and left him surviving as his sole heir the above named PETER COLE.

 That said ALLEN COLE died seized of the following described lands, situate in the County of Atoka, and State of Oklahoma, to-wit:

 The Southwest quarter of Section 13, Township 3 South, Range 14 East of the Indian Base and Meridian.

 That upon the death of said ALLEN COLE said lands descended to his heirs at law, therein above named, and became and are now alienable; That on the 21st day of July A. D. 1913 petitioner, PETER COLE, made and executed his certain deed of conveyance conveying all his right, title and interest in and to the said above described lands to J. B. NEAL for the price and sum of $1,200.00, which deed is now presented to this Court for approval; that petitioner has testified that he is entirely satisfied with said transaction and believes said consideration to be reasonable and adequate and the fair value of said land and that he desires to consummate said sale with the approval of this court; and the court being of the opinion that said sale is fair and equitable and that it will be for the best interest and proper benefit of said petitioner to approve said deed.

 Now Therefore it is hereby Ordered that the said deed of conveyance from the said PETER COLE to the said J. B. NEAL conveying the said above described one hundred sixty acres of land be and the same hereby ratified confirmed and approved and in all respects declared legal and valid.

 Dated this 1st day of August 1913.
